LAHORE: A three-member bench of the Lahore High Court (LHC) dismissed on Thursday petitions seeking disqualification of Mian brothers.
The petitions were filed by Shahid Orakzai in which he submitted that Mian Muhammad Shahbaz Sharif won provincial assembly election from PP-48 Bhakkar and became the Punjab chief minister and without resigning from PP-48, while he was also elected from PP-10 Rawalpindi, from where he later resigned.
Orakzai submitted that according to Constitution if a person was elected from a new constituency, his earlier seat would fall vacant. So, according to Constitution, PP-48 Bhakkar was still vacant, therefore, Shahbaz Sharif was not entitled to hold the office of chief minister, Orakzai submitted.
Regarding Nawaz Sharif, the petitioner submitted that since he had been convicted in the plane-hijacking case, he should be declared disqualified from contesting elections. The bench, headed by Justice Ijaz Ahmad Chaudhry, dismissed the plea against Nawaz on the grounds that it had become ineffective as by-polls had already been held in the constituencies where his candidature was challenged by the petitioner, while the petition against Shahbaz Sharif was rejected for non-prosecution.
Our correspondent adds: Prime Minister Yousuf Raza Gilani telephoned the PML-N Quaid, Mian Nawaz Sharif, and congratulated him on the Lahore High Court (LHC) decision in their favour.
